What to Expect at a Social Security Disability Hearing

If your initial application and reconsideration for Social Security Disability benefits have been denied, the next step is often a hearing before an Administrative Law Judge (ALJ). While the idea of a hearing may sound intimidating, understanding what to expect can ease your nerves and help you prepare.

The Basics of the Hearing

A Social Security Disability hearing is not like a courtroom trial. It’s private, relatively informal, and usually held in a small room or via video conference. The only people typically present are:

  • You
  • Your attorney (if you have one)
  • The Administrative Law Judge
  • A hearing reporter
  • Possibly a vocational or medical expert

The judge will ask you questions about your condition, how it affects your daily life, your work history, and any medical treatment you’ve received.

Common Questions You May Be Asked

  • What daily activities are difficult for you?
  • When did you last work, and what did your job involve?
  • How does your condition affect your ability to work or concentrate?
  • What medications are you taking and do they help?

The Role of an Attorney at the Hearing

An experienced disability attorney like Greg Kornegay can help by:

  • Preparing you for the types of questions the judge may ask
  • Presenting legal arguments on your behalf
  • Cross-examining any expert witnesses
  • Ensuring all your medical evidence is submitted properly

Legal representation can make a significant difference in your outcome.

How Soon Will You Get a Decision?

After the hearing, it may take several weeks, or even months, to receive the judge’s written decision. If approved, your benefits could be backdated to the time you became disabled.
