The Bottom Line on Social Security Disability
You have a good case if you have a medical problem that keeps you from working and some or all of these apply:
1. Your daily activities are seriously restricted. 2. You don’t get out and around to any significant degree. 3. You have pain that is so bad that medication does not help much. 4. You have a mental limitation. 5. You have a low educational level.
How do we prove that you have a medical problem that keeps you from working?
The best type of proof is medical tests (lab tests, x-rays, MRIs, etc.).
The second best type of proof is what your doctor says about your medical condition .
The third best type of proof is what you, your family and your friends say about your condition.
Golden Rule #1 Most cases have a mixture of the above types of proof. Judges feel more comfortable in awarding benefits to those folk whose cases relies heavily on medical tests and opinions that prove their disability. Your lawyer should know what mixture of proof will be required to win your case.
Golden Rule #2 Whenever possible, your doctor should complete a medical report describing your physical or mental limitations so the judge will know what you are capable of doing. Your lawyer should draft this report for your doctor to complete. The report should be geared towards the type of disability you have.
Golden Rule #3 If you have good medical evidence to prove your disability, you should win your case. Your lawyer should know the difference between good medical evidence and bad medical evidence for your particular disability.
